Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Fitverse mobile application and website at fitverse.pro (together, the “Service”), operated by Fitverse (“Fitverse”, “we”, “us”, or “our”). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

Fitverse is a B2B platform that enables gyms to manage coach-trainee relationships with AI-powered fitness and nutrition planning. Features include workout and diet plan generation, progress and activity tracking, messaging between coaches and trainees, and gym management tools. We may add, change, or remove features at any time.

2. Eligibility and Accounts

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Service. You are responsible for the accuracy of the information you provide and for keeping your login credentials confidential. You are responsible for all activity that occurs under your account. Notify us immediately of any unauthorized use.

3. Roles and Tenants

Accounts may be granted different roles (platform admin, gym owner, trainer/coach, or trainee). If you join the Service through a gym or coach, certain information you provide will be accessible to that organization so they can deliver coaching and management services to you, as described in our Privacy Policy.

4. Health and Fitness Disclaimer

Fitverse provides general fitness and nutrition information and AI-generated plans for informational purposes only. It is not medical advice and is not a substitute for consultation with a qualified physician or healthcare professional. Consult a doctor before beginning any exercise or nutrition program, especially if you have a medical condition, are pregnant, or are taking medication. You participate in any physical activity at your own risk.

5. Subscriptions and Payments

Some features are offered on a paid or subscription basis. Applicable fees, billing cycles, and capacity limits (such as the number of coaches) will be presented to you before purchase. Unless stated otherwise or required by law, fees are non-refundable. We may change pricing on a prospective basis with notice.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful, harmful, or fraudulent purpose;
• Upload content that is illegal, abusive, infringing, or violates others’ privacy;
• Attempt to gain unauthorized access to the Service, other accounts, or our systems;
• Interfere with, disrupt, or overload the Service or its infrastructure;
• Reverse engineer, scrape, or misuse the Service except as permitted by law;
• Impersonate any person or misrepresent your affiliation.

7. User Content

You retain ownership of content you submit (such as messages, photos, and logs). You grant Fitverse a worldwide, non-exclusive license to host, store, process, and display that content solely to operate and provide the Service to you and your gym or coach. You are responsible for ensuring you have the rights to the content you upload.

8. Intellectual Property

The Service, including its software, design, and trademarks, is owned by Fitverse and its licensors and is protected by intellectual property laws. These Terms do not grant you any right to use our branding without prior written permission.

9. Third-Party Services

The Service relies on third-party providers, including Google Firebase, for hosting and infrastructure. Your use of such services may also be subject to their terms and policies.

10. Termination

You may stop using the Service and request deletion of your account at any time. We may suspend or terminate your access if you violate these Terms or if necessary to protect the Service or other users. Provisions that by their nature should survive termination will survive.

11. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

12. Limitation of Liability

To the maximum extent permitted by law, Fitverse will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of or inability to use the Service.

13. Changes to These Terms

We may update these Terms from time to time. We will revise the “Last updated” date above and, where appropriate, provide additional notice. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
